MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 8 OF MONTGOMERY COUNTY, TEXAS NOTICE OF PUBLIC MEETING

NOTICE is hereby given that the Board of Directors of Montgomery County Municipal Utility District No. 8 (the “District” or “MUD 8”) of Montgomery County, Texas will meet in regular session, open to the public, on WEDNESDAY, MAY 12, 2021, at 9:00 A.M, via video and telephone conference call pursuant to Texas Government Code, Section 551.125, as amended, and as modified by the temporary suspension of various provisions thereof effective March 16, 2020, by the Governor of Texas in accordance with the Texas Disaster Act of 1975, all as related to the Governor’s proclamation on March 13, 2020, certifying that the COVID-19 pandemic poses an imminent threat of disaster and declaring a state of disaster for all counties in Texas.

All members of the public may participate in the meeting via video conference or telephone conference call, at which meeting the following items will be discussed:

1. Consideration of public comments (public comment shall be limited to 3 minutes per member of the public);

2. Approve minutes of April 14, 2021 regular meeting;

3. Tax Assessor/Collector’s Report, including:
a. review collection report; and
b. review Delinquent Tax Report;

4. Authorize casting of official ballot for the Montgomery Central Appraisal District’s Board of Directors Election;

5. Bookkeeper’s Report, including:
a. review and approve financial reports;
b. review cash flows;
c. authorize payment of bills; and
d. review and approve Quarterly Investment Report (1st quarter 2021);

6. Engineer’s Report, including:
a. update on status of Wastewater Treatment Plant (“WWTP) Improvement Project;
b. authorize submittal of renewal application for TPDES WWTP Discharge Permit;
c. update on status of Drainage Improvements Project, Phase II;
d. update on status of Montgomery County Municipal Utility District No. 9 (“MUD 9”) Buckingham Groundwater Storage Tank Rehabilitation Project;
e. update on status of cleaning and televising of certain wastewater lines, including review bids for award of contract, authorize preparation of construction contract, authorize execution of construction contract, and authorize Engineer to issue notice to proceed as approved, subject to Attorney review;
f. update on status of design of Motor Control Center and Control Building replacement at Water Plant Nos. 1 and 2; and
g. update on status of Risk and Resilience Assessment required by Environmental Protection Agency;

7. Operator’s Report, including:
a. review monthly water and wastewater operations;
b. report on delinquent accounts and discuss resuming service terminations;
c. review Catahoula operations;
d. review Ground Water Reduction Plan Monthly Operations Report;
e. update status of valve location project; and
f. status of submittal of Annual Water Loss Audit to Texas Water Development Board;

8. Review amendment to Operations contract and fee schedule, and take any necessary actions on same;

9. Update on insurance claims for damages related to wastewater backflows;

10. Update on claims filed for damages against Tachus’ subcontractors;

11. Approve distribution of Drinking Water Quality Report (“CCR”);

12. Update on incentives to increase use of e-statements billing, and take any necessary actions on same;

13. Consider amending Rate Order, and take any necessary actions on same;

14. Update on District’s website and communications services;

15. Miscellaneous Reports, including updates on:
a. Walden Community Improvement Association;
b. MUD 9 meetings; and
c. Lone Star Groundwater Conservation District meetings;

16. Discuss Association of Water Board Directors Trustee and Bylaws Election, and take any necessary actions on same;

17. Attorney’s Report, including:
a. approve Release of All Claims between District and Hays Utility North Corporation and Hays Consulting Corporation related to damage to District lines; and
b. legislative update; and

18. Executive Session, as necessary;
a. as may be permitted by Sec. 551.072, Texas Gov’t Code, concerning real estate, security, litigation, or matters involving attorney-client privilege;
b. reconvene in Open Session; and
c. vote on matters discussed in Executive Session, if any.
