MONTGOMERY COUNTY MUNICIPAL UTILITY DISTRICT NO. 8 OF MONTGOMERY COUNTY, TEXAS

NOTICE OF PUBLIC MEETING

NOTICE is hereby given that the Board of Directors of Montgomery County Municipal Utility District No. 8 (the “District” or “MUD 8”) of Montgomery County, Texas will meet in regular session, open to the public, on WEDNESDAY, SEPTEMBER 8, 2021, at 9:00 A.M, at the Walden Yacht Club, 13101 Melville Drive, Montgomery, Texas 77356, at which meeting the following items will be considered:

1. Consideration of public comments (public comment shall be limited to 3 minutes per member of the public);

2. Approve minutes of August 11, 2021 regular meeting;

3. 2021 Tax Rate, including:
a. conduct public hearing on tax rate (members of the public will be granted an opportunity to provide comments related to the 2021 tax rate);
b. adopt Order Setting Rate and Levying Tax for 2021;
c. adopt Order Appointing Tax Assessor/Collector;
d. adopt Resolution Concerning Tax Collection Procedures; and
e. approve Amended and Restated District Information Form;

4. Tax Assessor/Collector’s Report, including:
a. review collection report;
b. review Delinquent Tax Report, including recommendations for termination of water and sewer service to delinquent taxpayers; and
c. conduct public hearing on termination of service for failure to pay taxes;

5. Bookkeeper’s Report, including:
a. review and approve financial reports;
b. review cash flows;
c. authorize payment of bills;
d. review and approve Quarterly Investment Report (2nd quarter 2021); and
e. discuss engagement of Mark Burton to prepare District financial statements to comply with SAS 115 requirements;

6. Update on status of District’s budget for fiscal year ending December 31, 2022;

7. Review Policies on Capitalization and Depreciation of District’s Assets, and take any necessary actions on same;

8. Engineer’s Report, including:
a. update on status of Wastewater Treatment Plant (“WWTP”) Improvement Project;
b. update on status of renewal application for TPDES WWTP Discharge Permit;
c. update on status of Drainage Improvements Project, Phase II;
d. update on status of Sanitary Sewer Cleaning and Televising Project;
e. update on design of Motor Control Center and Control Building Replacement Projects for Poe Street and Browning Street Water Plants, including review proposal for pre purchase of equipment, and take any necessary actions on same; and
f. authorize preparation of America’s Water Infrastructure Act Emergency Response Plan;

9. Operator’s Report, including:
a. review monthly water and wastewater operations;
b. report on delinquent accounts and discuss resuming service terminations, and take any necessary actions on same; and
c. review calculation of Jasper pumpage;

10. Update on claims filed for damages against Tachus’ subcontractors;

11. Authorize Rate Order Study;

12. Update on District’s website and communications services, including:
a. review website proposal from Off Cinco for joint website with Montgomery County Municipal Utility District No. 9 (“MUD 9”), and take any necessary actions on same; and
b. discuss procedures for communicating service-related issues with customers;

13. Miscellaneous Reports, including updates on:
a. Walden Community Improvement Association (“WCIA”);
b. MUD 9 meetings; and
c. Lone Star Groundwater Conservation District meetings;

14. Attorney’s Report, including:
a. update on matters involving the WCIA;
b. adopt Order Establishing a Records Management Program and Designating a Records Management Officer; and
c. review 87th Legislative Update Memorandum; and

15. Executive Session, as necessary:
a. as may be permitted by Sec. 551.072, Texas Gov’t Code, concerning real estate, security, litigation, or matters involving attorney-client privilege;
b. reconvene in Open Session; and
c. vote on matters discussed in Executive Session, if any.
